This includes information such as name, address, telephone number, date of birth or IP addresses.   <\/p>\n<p>With this data protection notice, we inform you in accordance with Art. 12 et seq. GDPR about which personal data is processed when you visit and use our platform. In particular, you will find information below on what data we collect in connection with your visit and use of our platform, what we use the collected data for and for what purposes the data is collected. You will also find information on the rights to which you are entitled in connection with the processing of your personal data.  <\/p>\n<p>We reserve the right to adapt this data protection information with effect for the future, in particular in the event of the further development of our platform, the use of new technologies or changes to the legal basis or the corresponding case law. You can recognize an encrypted connection by the character string https:\/\/ and the lock symbol in the address bar of your browser. <\/p>\n<\/p>\n<ol start=\"4\">\n<li><strong>Purposes and legal bases of processing<\/strong><\/li>\n<\/ol>\n<p><strong>Accessing and visiting our platform &#8211; server log files<\/strong><\/p>\n<p>For the purpose of the technical provision of our platform, it is necessary for us to process certain information automatically transmitted by your browser so that our platform can be displayed and used in your browser. This information is automatically collected each time you visit our platform and stored in so-called &#8220;server log files&#8221;. The information transmitted by your browser and stored in the server log files is the following information:  <\/p>\n<ul>\n<li>IP address<\/li>\n<li>Date and time of the request<\/li>\n<li>Time zone difference to Greenwich Mean Time (GMT)<\/li>\n<li>Content of the request (specific page)<\/li>\n<li>Access status\/HTTP status code<\/li>\n<li>Amount of data transferred<\/li>\n<li>Platform from which access is made (referrer URL);<\/li>\n<li>Browser type and browser version;<\/li>\n<li>Operating system used<\/li>\n<\/ul>\n<p>The storage of the aforementioned access data is necessary for technical reasons in order to provide our platform and to ensure system security. This also applies to the storage of your IP address, which is necessary and, under further conditions, can at least theoretically enable an assignment to your person. In addition to the aforementioned purposes, we use server log files exclusively for the needs-based design and optimization of our platform purely statistically and without drawing any conclusions about your person. This data is not merged with other data sources, nor is it analyzed for marketing purposes.   <\/p>\n<p>The access data collected as part of the use of our platform is stored for the period for which this data is required to achieve the aforementioned purposes. Your IP address is stored on our web server for a maximum of 7 days for IT security purposes. <\/p>\n<p>If you visit our platform to find out about our range of services or to use them, the basis for the temporary storage and processing of access data is Art. 6 para. 1 sentence 1 lit. b GDPR, which permits the processing of data for the performance of a contract or for the implementation of pre-contractual measures. In addition, Art. 6 para. 1 sentence 1 lit. f GDPR serves as the legal basis for the temporary storage of technical access data. Our legitimate interest here is to be able to provide you with a technically functioning and user-friendly platform and to ensure the security of our systems.      <\/p>\n<p><strong>Use of the platform<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\">Registration<\/span><\/p>\n<p>In order to use our platform, prior registration is required. All you need to do to register is provide an e-mail address and a password. For security reasons, we will then send a verification code to the e-mail address you have provided to ensure that the e-mail address you have provided is actually your e-mail address.  <\/p>\n<p>Once you have successfully verified your e-mail address by entering the verification code, the registration process is complete.<\/p>\n<p>The data collected in connection with the registration is processed for the purpose of implementing the user relationship established by the registration and, if necessary, for the initiation of further contracts on the basis of Art. 6 para. 1 lit. b GDPR.  <\/p>\n<p><span style=\"text-decoration: underline;\">Provision of information<\/span><\/p>\n<p>Within our platform for agricultural business optimization, business analyses and recommendations are generated by processing various data sources. The following data is processed to generate the business analyses and recommendations: <\/p>\n<ul>\n<li>Local weather data<\/li>\n<li>Soil data<\/li>\n<li>Market data<\/li>\n<li>Company-specific data provided by the user<\/li>\n<\/ul>\n<p>The aforementioned data is processed by us to create business optimization calculations on a per hectare basis, site-specific nitrogen recommendations and for analyses to optimize the use of operating resources. In addition, we process the data provided by you in anonymized form for our own purposes, in particular for the creation of anonymized statistics and evaluations. <\/p>\n<p>The processing of the aforementioned data is carried out to provide the functionalities of our portal on the basis of Art. 6 para. 1 lit. b GDPR, insofar as these have a personal reference.  <\/p>\n<p>The information collected will be stored by us for as long as you are registered as a user of our portal and will then be deleted. Statutory retention periods remain unaffected <\/p>\n<p><span style=\"text-decoration: underline;\">Location data (agmeo Mobile app)<\/span><\/p><p>Our mobile app \u201cagmeo Mobile\u201d can access the location data of your device (GPS, Wi-Fi and cell-network positioning). Access only takes place if you have granted the corresponding permission in the settings of your operating system. You can withdraw this permission at any time in the system settings of your device; the app then remains usable with a reduced range of functions. We process location data for the following purposes:<\/p><p><strong>a) Location-based functions while using the app<\/strong><\/p><p>When you open the map or create a record (note, photo, voice note, receipt or field operation), the app determines your current location for as long as the respective screen is open. The location is used to show your position on the map, to automatically assign the record to the correct field of your farm (the matching against the field boundaries takes place locally on your device) and to attach a location reference to the record. When a record is created, the latitude, longitude and positioning accuracy at the time of the record are stored on your device together with the record and transmitted to our servers so that the record can be documented and evaluated in your farm with a location reference. The records can be viewed by the users of your farm in the agmeo platform.<\/p><p>The legal basis is Art. 6 para. 1 lit. b GDPR (provision of the function requested by you). Access to the location sensors of your device takes place in accordance with Section 25 para. 2 no. 2 TDDDG (German Telecommunications Digital Services Data Protection Act), as it is necessary for the function expressly requested by you.<\/p><p><strong>Weather information:<\/strong> If you have allowed location access, the app shows you weather data and spraying windows for your current location. For this purpose, the coordinates of your current location are transmitted to the weather service Open-Meteo (Open-Meteo.com, Switzerland; https:\/\/open-meteo.com), which, according to its own information, does not store the request and does not maintain user accounts. An adequacy decision of the European Commission pursuant to Art. 45 GDPR exists for Switzerland. The legal basis is Art. 6 para. 1 lit. b GDPR. Without location access, weather data is retrieved for the location of your fields.<\/p><p><strong>b) Live location sharing (also in the background)<\/strong><\/p><p>Optionally, you can activate the \u201cLive location\u201d function in the app. If the function is activated, the app records your position continuously \u2013 also in the background while the app is not open \u2013 and transmits it to our servers. The data processed are your position (latitude and longitude), the time, speed, heading and accuracy of the positioning and \u2013 if selected by you \u2013 the machine currently in use. The data is linked to your user account and to the farm for which sharing was active at the time of recording.<\/p><p>The live locations are displayed to the users of your farm on a map in the agmeo platform (current position and the track of the last few hours, together with your name and the telephone number stored for you) in order to coordinate field work, dispatch machines and drivers and to be able to make contact in an emergency. The data is not passed on to other farms or to third parties; our hosting service providers receive the data exclusively as processors.<\/p><p>Live location sharing is deactivated by default. It is based on your consent pursuant to Art. 6 para. 1 lit. a GDPR and Section 25 para. 1 TDDDG, which you declare by granting the \u201cAllow all the time\u201d permission and activating the switch in the app. You can withdraw your consent at any time with effect for the future by deactivating the switch in the app or withdrawing the location permission in the system settings. Transmission also ends automatically when you switch farms or sign out. While sharing is active, the app displays this permanently.<\/p><p>Insofar as you use the app as an employee of a farm, the farm decides on the use of the live location function and the evaluation of the data. In this respect, the farm is the controller under data protection law; we process the data on its behalf as a processor pursuant to Art. 28 GDPR.<\/p><p><strong>Storage period:<\/strong> The location reference stored with a record (letter a) is stored for as long as the record itself, i.e. until you or your farm delete the record or the user relationship ends. Live location data (letter b) is only cached on your device until it has been transmitted. On our servers, it is stored for as long as you are a member of the respective farm and deleted when your membership of the farm ends or your user account is deleted, unless statutory retention obligations prevent this. Using the \u201cDelete data\u201d function in the app, you can remove all data stored locally on your device at any time.<\/p><p><strong>c) Map display in the app<\/strong><\/p><p>To display the map in the app, map tiles are loaded from our servers and from the OpenFreeMap service (https:\/\/openfreemap.org, operated by Zsolt Ero, Hungary). In doing so, your IP address and the displayed map section are transmitted to the respective map server. The legal basis is our legitimate interest in a functioning map display pursuant to Art. 6 para. 1 lit. f GDPR.<\/p><p><strong>Use of cookies and associated plugins\/tools<\/strong><\/p>\n<p><span style=\"text-decoration: underline;\">Cookies<\/span><\/p>\n<p>We use so-called &#8220;cookies&#8221; on our website. Cookies are small text files that are stored on the hard disk of the device you use to access our website. The characteristic character strings contained in the cookies can be used to identify the browser you are using when you visit our website. Cookies cannot execute programs or transmit viruses to the device you are using.
